Terms of Service

These terms govern your use of BigBrainLearning ("BBL", "we", "us"). By creating an account or using the service, you agree to them.

1. What BigBrainLearning does

BigBrainLearning is a personal knowledge tool. You import content you have already saved on third-party platforms — currently Instagram — and we organize it, make it searchable, and let you generate written outputs from it using AI models. We do not host, rebroadcast, or republish the original videos.

2. Eligibility and your account

  • ·You must be at least 16 years old, and old enough to form a binding contract where you live.
  • ·You are responsible for everything that happens under your account, including keeping access to your email secure. Sign-in uses your email address, so anyone with access to that inbox can access your account.
  • ·One account per person. Do not share credentials or resell access.
  • ·You must give accurate information and keep your billing details current.

3. Your content, and the rights you give us

You keep ownership of everything you import and everything we generate for you. You grant us only the limited licence needed to run the service for you: to store your data, transmit it to the processors listed in our Privacy Policy, generate outputs at your request, and display it back to you.

We do not sell your content, publish it, or use it to train AI models. We may use aggregated, de-identified statistics (for example, total items processed) to operate and improve the service.

You confirm that you have the right to import the content you submit, and that doing so does not breach the terms of the platform it came from or anyone else's rights.

4. Third-party platforms

BigBrainLearning is not affiliated with, endorsed by, or sponsored by Meta, Instagram, or any other platform. Your use of those platforms remains governed by their own terms. We rely on data exports those platforms provide to you. If a platform changes or withdraws that capability, parts of the service may stop working, and that is outside our control.

Content you import remains the property of its original creators. Outputs we generate are for your own reference and learning. If you republish anything derived from someone else's content, that is your responsibility, including any attribution or permission required.

5. Plans, transformations, and library capacity

  • ·Free, Lite, and Pro plans differ in how many items your library holds and how many transformations you get each month. Current limits are always shown on your Account page and are authoritative.
  • ·A transformation is a unit of AI generation. Transforming one item uses about one transformation; transforming many together uses roughly one per source item. More demanding transformation types may use proportionally more.
  • ·Included monthly transformations reset each billing cycle and do not roll over. Any separately purchased transformations do not expire and are used after your monthly allowance.
  • ·Browsing, searching, filtering, opening items, and reopening outputs you already generated never use transformations.
  • ·Library capacity may be extended by one-time purchases in blocks. Purchased capacity is persistent for your account and is not a recurring charge.
  • ·We may adjust plan limits and pricing. If a change reduces what you currently pay for, we will give reasonable notice before it applies to your renewal.

6. Billing, renewal, and cancellation

  • ·Paid plans are billed in advance on a recurring basis through our payment processor until cancelled.
  • ·You may cancel at any time. Cancellation stops future renewals; you keep paid access until the end of the period you have already paid for.
  • ·Except where the law requires otherwise, payments are non-refundable, including for partial periods and for unused transformations. We may issue refunds at our discretion.
  • ·One-time library capacity purchases are non-refundable once the additional capacity has been used to process content.
  • ·If a payment fails, we may suspend paid features until it is resolved.
  • ·You are responsible for any taxes that apply to your purchase.

7. AI-generated outputs

Outputs are produced by automated systems from the content you supply. They can be incomplete, wrong, or misleading, and they are not professional advice of any kind — medical, legal, financial, or otherwise. Verify anything you intend to rely on. You are responsible for how you use outputs.

Because outputs are cached, requesting the same transformation on the same content again returns your stored result rather than generating (and charging) a second time.

8. Acceptable use

You agree not to:

  • ·Import content you do not have the right to import, or content that is unlawful.
  • ·Use the service to infringe intellectual property, harass anyone, or violate anyone's privacy.
  • ·Attempt to access another user's data, probe or bypass our security or plan limits, or interfere with the service's operation.
  • ·Scrape, resell, or redistribute the service, or use it to build a competing product.
  • ·Use automated means to create accounts or generate load beyond normal personal use.

We may suspend or terminate accounts that breach these terms, that create risk or cost we cannot reasonably absorb, or where required by law.

9. Availability and changes

The service is provided as-is and may change. We do not promise uninterrupted availability, and we may modify, suspend, or discontinue features. We depend on third-party providers for processing, hosting, and AI generation; outages there may affect us. Where we plan a material adverse change we will make reasonable efforts to give notice.

10. Ending your account

You can delete your account at any time from the Account page. Deletion removes your library, imports, generated outputs, and collections. This is permanent and cannot be undone — export anything you want to keep first. Deleting your account does not by itself refund amounts already paid; cancel your subscription separately if it is active.

11. Disclaimers and limitation of liability

To the fullest extent permitted by law:

  • ·The service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
  • ·We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or lost opportunities.
  • ·Our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the twelve months before the claim, or fifty US dollars.

Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you. Nothing here limits liability that cannot lawfully be limited.

12. Indemnity

You agree to indemnify and hold us harmless from claims, losses, and expenses arising out of the content you import, your use of outputs, or your breach of these terms or of any third-party platform's terms.

13. Governing law and disputes

These terms are governed by the laws of the State of Oregon, United States, without regard to conflict-of-law rules. You and we agree to try in good faith to resolve any dispute informally by contacting support@bigbrainlearning.app before starting formal proceedings.

14. Changes to these terms

We may update these terms. If a change is material, we will notify you by email or in the app before it takes effect. Continuing to use the service after that means you accept the updated terms. If you do not, stop using the service and delete your account.
